First trial hearing is December 4, 2009!
We have appealed the Board’s decision to place a landfill on Forrest School Road to the Circuit Court. There will be a hearing on this on Friday, December 4 at 9:00 am at the Lee County Circuit Court building located at West Jefferson Street in Tupelo, MS.
The Alcorn County Board of Supervisors has filed a motion asking the court to dismiss our appeal on the grounds that their resolution to place a landfill on Forrest School Road was not a final decision and that their decision doesn’t become final until MDEQ approves or disapproves the plan. Our attorneys will, of course, argue otherwise.
The sad, but outrageous thing here is that this is another attempt of the board not to allow we, the citizens of Alcorn County to speak. They voted not to let us speak in July 2008 when we had the signatures of over 700 voters on a petition asking them not to place the landfill near homes and now they don’t even want to let us have our day in court.
Well, it sure feels like a decision to those of us who live near the site and those of us who have been fighting it. They’ve refused to answer our questions about why they chose this location or how much this decision has cost and will cost the taxpayers and now they argue that they haven’t even made a decision. I guess raising our taxes another 4 mils wasn’t a decision, either!
Their decision to place a landfill on Forrest School Road and their motion to dismiss our appeal shows their continued disregard for the freedoms our forefathers have fought so hard to provide and our soldiers still fight to maintain today. Apparently, freedom of speech, the right to a trial, and life, liberty, and the ‘pursuit of happiness’ are rights the supervisors feel we are not entitled to.
Feel free to attend the hearing and show your support for our cause. Even if we lose this first case, we will appeal through the Supreme Court…and we’ll continue the fight through every avenue available!
Pass this information along to your email friends so they know what freedom means to the Alcorn County supervisors…and once again, call your supervisor and tell them you don’t agree with their decision. Call your state representatives and senators and tell them we need stronger laws to protect us from decisions like this - remember they can put a construction and debris (rubbish) landfill 500 feet from the corner of your house. That tends to dampen your ‘pursuit of happiness’ if you have to look at trucks dumping garbage all day. It also tends to dampen your life expectancy if your air, soil, and groundwater become polluted from the garbage dumped just 500 feet away.

Wenasoga is an unincorporated community in northern Alcorn County, Mississippi, United States. It is situated northwest of Corinth near the Tennessee border.
For the residents who live there it is heaven – it is home. Many of the residents have lived there all their lives, as did their parents and grandparents. Several families have been there for six and seven generations. It is a peaceful community where everyone knows their neighbors and it represents everything good about this country.
Unfortunately that peace and quiet is being threatened by the Alcorn County Board of Supervisors who want to place a landfill there. Community residents are fighting it, but as with every battle, it’s tough – but our resolve is strong. The Lord and the land give us strength. The future of our children give us hope. Join our fight.
